Safety Guidelines and Requirements
Our number one goal is to create a fun and safe atmosphere for people to come together and enjoy each other and the Dwellings Farms experience. In order to do that, we have some simple but necessary safety guidelines and requirements that must be followed by any and all guests.
​Farm Rental Safety Guidelines and Requirements

AGRITOURISM. WARNING. Under Virginia law, there is no liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity.

The property and buildings/structures are primarily for agriculture use and are constructed as such. Please be mindful of this and use caution.

Every guest under 18 must be accompanied by a parent or assigned guardian. That guardian is responsible for the safety and actions of their minor. Guardians are aware of possible risk of drowning, injury by animal, or any other possible dangerous scenario and are responsible for their minor.

Renters/Guests must keep children off of fencing and do not let them crawl under, through, or climb above. Animals may be dangerous. The Landlord is not responsible for any injury or death.

Renters/Guests must abide by all signage and property representatives and are responsible for following the expressed rules.

No Renters/Guests are permitted on the property without a scheduled and confirmed appointment or booking. It will be considered trespassing if guest is on the property without confirmed consent from a property representative.

Renter/Guests are not permitted to bring outside food for the animals. Guests are not to feed the animals.

Renters/Guests are not to enter any animal enclosure or pasture due to danger of injury or death.

Renters/Guests may NOT feed or pet animals.

Renters/Guests are aware that animals may bite, kick, stomp, or head butt.
Guests are encouraged to not startle the animals and be calm while engaging
with them.

Renters/Guests are not to climb over or under any fencing and to use designated
gates only.

Renters/Guests are encouraged to use hand sanitizer and/or wash hands before
and after engaging in any activities.

Renters/Guests are required to use extreme caution around any and all bodies of
water and use/provide their own floatation safety devices as needed.

At no time is entering any bodies of water on or around the property permitted.

Renters/Guests are encouraged to familiarize themselves with their surroundings
to avoid getting lost or disoriented.

Renters/Guests should familiarize themselves with the location of all safety items
such as floatation devices, fire extinguishers, first aid kits, etc.

Renters/Guests are encouraged to use extreme caution when engaging in any
activity on the property.

Renters/Guests are encouraged to be aware of their surroundings and scan their areas for any wildlife, poisonous insects, plants, or reptiles, or any potentially hazardous situations and avoid these situations and alert a property representative of the danger.

Renters/Guests are encouraged to dress according to the weather and forecast, wear closed toes shoes, and supply any protective gear or items needed for their visit.

Dwellings Farms and its owners, members, affiliates, and representatives are not responsible for injury, death, or accident.

Renters/Guests are to use reasonable and responsible judgement in regards to safety.

Renters/Guests are to park in the designated parking areas and not block any part of the driveway. All vehicles at the property need to be able to pull in and out freely. The driveway is required to be clear enough for emergency vehicles to access all areas of the property in case of emergency.

Renters/Guests are not permitted to put any holes in any walls or other parts of the dwelling or other structures around the property for any reason, including to hang decorations for the Rental Period.

Renters/Guests are not permitted to put anything on or near the fencing to avoid the animals ingesting harmful items and damage to the fencing. This includes decor such as balloons, ribbon, banners.

Renters/Guests are not permitted to use any item or feature of the Site for any purpose other than for its intended use.

Renter/Guests are prohibited from opening any garage door unless in an emergency situation such as fire. If the Renter desires the garage doors open during the Rental Period, written permission must be obtained in writing from Landlord and all air condition/heat must be off.

Renters/Guests are not permitted to possess or consume alcohol while at the property without the required license or permit obtained from the authorities. Copy of this license/permit must be provided to Landlord prior to fifteen (15) days before the start of Rental Period.

The Landlord and/or any of the property representatives have the right to remove any Renters/Guests who are being unsafe, under the influence of drugs or alcohol, not following the rules, etc.

Smoking is only permitted in a designated location far from The Barn, any structures, animals, trees, or fencing. Renter and guests are prohibited from leaving cigarette ashes and butts on the property.

No smoking or open flame is permitted in The Barn or any other covered structure.

Littering is prohibited on property.

Illegal substances and items are prohibited on property.

Renter is responsible for the removal of all trash/waste associated with the
Rental Period.

The Renter is responsible for the cleanup of the Site at the end of the Rental
Period.

Fires and grills are only permitted with written consent from Landlord. Any fire must be in the Landlord’s provided fire pits (2 max). Fire pits and grills are only permitted outside, on an uncovered patio or driveway, and at least fifteen (15) feet from any/all structures, fences, trees, vehicles, etc. Renter is responsible for removal/clean up of all ashes/waste. Ashes/waste from fires and grills are not to be dumped on or around the property. Fires and grills must be supervised and monitored at all times and must never be left unattended. Fires and grills must be extinguished prior to the end of the Rental Period. Fires and grills must be within reach of a water hose. Renter is responsible for providing a fire extinguisher and water hose and locating it near fire area during the Rental Period. No sparklers, fireworks, open flame, or other forms of fire or spark is permitted.

No confetti is permitted on property.

No glass is permitted on property due to risk of injury to persons, animals, and
property.

Any/all music or amplified sound must be played through the Landlord’s sound
system. The volume is to not be loud enough to be heard by neighbors. The Landlord, its representatives, members, trustees, employees, agents, and affiliates have the right to adjust the volume as needed.

Renter is responsible and aware of the addresses and locations of the property in case of emergency. The Barn is located at 2349 Baum Rd., Chesapeake, VA. The property on Ansell is located at 2100 Ansell Rd., Chesapeake, VA.

These safety guidelines and requirements are to be abided by any/all times Renter, guests, vendors, etc are on the property.

Dwellings Farms does NOT hold an ABC license or any other license/ permit pertaining to activities related to the Renter’s Rental Period. The Renter is responsible for obtaining any licenses/permits required during the Rental Period.

The Renter shall be liable for any physical damages to the Landlord’s property, legal actions, and/or loss of reputation or business opportunities that the Landlord may incur as a consequence of the actions by the Renter, affiliates, officers, agents, employees, invitees, guests, vendors, contractors, Renter’s property, or any other person under authority of the Renter or relating to the Rental Period. The Renter agrees to defend, indemnify, and hold harmless the Landlord, its representatives, members, trustees, employees, agents, and affiliates from and against all claims, suits, damages, costs, and expenses arising from injury or death to persons or damages to property occurring while the Renter and any of its affiliates, officers, agents, employees, invitees, guests, vendors, contractors, or any other person on the Landlord’s property under authority of the Renter or relating to the Rental Period. The Landlord will not be liable for any loss or damage to equipment or property of the Renter or its affiliates, officers, agents, employees, invitees, guests, vendors, contractors, or any other person on the Landlord’s property under authority of the Renter or relating to the Rental Period caused by negligence, theft, acts of God, or any other cause. The Renter agrees to indemnify and hold harmless the Landlord against any and all legal actions which may arise from the Renter’s use of the Landlord’s property

The Renter/Guests are aware that the Landlord’s property is considered a farm and consists of animals, equipment, and wildlife. The Renter, any of its affiliates, officers, agents, employees, invitees, guests, vendors, contractors, or any other person on the Landlord’s property under authority of the Renter or relating to the Rental Period are prohibited from entering any animal enclosures, petting animals, feeding animals, or interacting with any farm equipment or structures. The Renter agrees to defend, indemnify, and hold harmless the Landlord, its representatives, members, trustees, employees, agents, and affiliates from and against all claims, suits, damages, costs, and expenses arising from injury or death to persons or damages to property occurring while the Renter and any of its affiliates, officers, agents, employees, invitees, guests, vendors, contractors, or any other person on the Landlord’s property under authority of the Renter or relating to the Rental Period, are on the Landlord’s property.

The Landlord, its representatives, members, trustees, employees, agents, and or affiliates may change the plan for the Rental Period and relocate any tents, property, equipment, or move/adjust any other items of the Renter or its affiliates, officers, agents, employees, invitees, guests, vendors, contractors, or any other person on the Landlord’s property under authority of the Renter or relating to the Rental Period. The Landlord, its representatives, members, trustees, employees, agents, and or affiliates will not be liable for this action and no refunds will be due or paid to the Renter if the Landlord acts pursuant to this paragraph.

The Landlord, for any reason and at their sole discretion, may terminate a Rental Agreement if the Renter fails to comply with any term of the Agreement or if the Landlord determines that the Renter’s use of the Site poses an unacceptable risk of damage or harm.
